It must include the person up for conviction and any previous convictions that they may have. It is a summary of the whole case, what happened and what was involved in it, witness statements, an item like of the evidence, the analyses of the evidence, for example red splatter which was found to be the blood of the victim. The CPS (crown prosecution service) will then present this report to the whole of the court room, they do this first, giving a chance to the defence to counteract it, after this has take place, the judge will make a decision.
At the end of the case, the police arrested Sion Jenkins for the murder of Billie Jo down to the evidence of the blood spatter on his jumper. The was no other evidence against Sion, his two daughters were not allowed to give him an alibi in court down to Lois's decision not to let them, out of her anger toward Sion. The bloodied hand print that was found on the door had to be discounted for as forensics discovered it three days later, and Sion's statement which a police officer took at the scene of the crime also had to be discounted as it was not wrote down until days later, being recalled from the officers memory. The report written by the police was presented in courts and the Judge and Jury decided Sion was guilty and sentenced to life imprisonment
Sion swore he was not guilty of this crime and appealed it time and time again on lack of evidence, the appeal was quashed in 1999, and re appealed in 2004, were experts gave testimony that the blood spatter could of came from Billies airways when Sion was tending to her.. After 39 hours the retrial was unable to come up with a majority verdict and in 2006, Sion was declared not guilty and released.
Atoni is now serving 7 life sentences for a string of violent sex attacks on females whilst Sion was locked away.
This stage is the crucial last stage, the criminal is about to be convicted and how this is handled in court and how the case file is presented against them, are the stepping stones to a conviction. If an improper report is written or case file isn't very well put together, the CPS will then still have to present this to the court. It could be missing evidence, the procedures followed or any crucial information. If anyone of this is over looked, there will not be the strongest form of prosecution set against the defendant giving their defence a chance to fire back and reduce a sentence or get an aquittal. The judge can also aquit the defendant do to police procedures left out of the case files. In my case, the way the evidence of the blood spattered jumper belonging to Sion and his actions after the crime was presented in court, is what lead to the successfull outcome of the case. However on appeal when this evidence was reviewed, the court decided it was insufficient evidence as it could be disproved, leading to the future aquittal of Sion Jenkin's. It goes without saying that this stage is highly beneficial to the outcome of a case.
